Fields of application and modification of the general conditions of sale

These General Conditions of Sale (hereinafter "GTC") are concluded exclusively between (1) the company MOD DESIGN, registered with the RCS of Paris under the siren number 732 032 388 whose head office is located at 103 rue Lafayette 75010 Paris in its capacity as publisher of the site, an online ready-to-wear sales service, exclusive holder of the license to use the LDB brand on the web (hereinafter referred to as LDB and (2) any person making a purchase on the LDB site (hereinafter referred to as the "Customer").
The publisher reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will be applied to each order.
These general conditions of sale concern exclusively non-commercial individuals.

These general conditions of sale relate exclusively to non-commercial individuals aged at least 18 years.
The customer is understood as any natural person who acts for purposes that do not fall within the scope of his commercial, industrial, craft or liberal activity, aged at least 18 years and having ordered at least once on the site.
The creation of a customer account is reserved for all natural persons and aged at least 18 years.

Product availability

Our product offers and prices are valid as long as they are visible on the site. Upon receipt of your order, we check the availability of the product(s) ordered. In the exceptional case of unavailability, we undertake within 30 days from the validation of the order, either to deliver the ordered product to you or to reimburse you for it using the means of payment used when placing your order.
The date of registration of the order corresponds to the date of payment by credit card online with the secure payment terminal of our partner.
In the event of an exceptional out of stock on one of the products in your order, we will ship the rest of your order, accompanied by an information message on the preparation slip.
The amount of transport costs relating to the delivery of the items will be automatically displayed on the Site at the time of validation of the shipping method chosen by the customer and will be communicated again to the customer when confirming his order by e-mail. mail.

Validation of orders and electronic signature

Any order validated by clicking on the "Confirm my order and pay" button during the ordering process implies irrevocable acceptance of these general conditions of sale.
Clicking on the "Confirm my order and pay" button associated with the authentication and non-repudiation procedure and the protection of the integrity of the messages constitutes an electronic signature. This electronic signature has value between the parties in the same way as a handwritten signature.


LDB reserves the right to modify its prices at any time but undertakes to apply the prices displayed at the time of your order, subject to availability on that date.
The products remain the property of LDB until full payment has been received by LDB.

Methods of payment and security

Payment terms

Regardless of the method of payment chosen from among those accepted on our site, orders will only be deemed registered after validation or receipt of payment.
Thus, as long as the payment is not validated by the intermediary chosen by the consumer, the order cannot be prepared by LDB services.
Cash payment by credit card
You can pay by credit card (Carte bleue, Visa, Maestro, Eurocard/Mastercard): in this case, payment is made on our partner's website. This implies that no banking information concerning you passes through the LDB site. Payment by credit card is therefore perfectly secure. Your order will thus be registered as soon as the payment is accepted by the banking service. You can pay online with confidence by entering the number, the expiry date of your credit card and the security code on the back of it in the spaces provided for this purpose.
Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is made directly to the bank. LDB has no access to these coordinates, and does not keep them on its servers. This is why they are requested from you with each new transaction on our site.

Fight against fraud

LDB reserves the right to check the validity of the payment, before the dispatch of the order, by any means that LDB deems necessary (in particular the request for identity documents, proof of residence, etc.).

Default of payment

LDB reserves the right to refuse to make a delivery or to honor an order from a customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. In the event of fraud, LDB reserves the right to remove any member without notice or compensation.


Order preparation times

LDB reserves the right to subcontract all or part of the preparation and dispatch of the order to a third party mandated to perform this service.
Orders are prepared within 48 working hours, you must add transport delivery times.
Orders placed on a Saturday, Sunday or public holiday will be processed the next business day.
In the event of public holidays, periods of high activity such as sales, bad weather, exceptional closures or traffic bans, processing and delivery times may be extended.
The order is delivered to the address appearing on the order form. In the event of an input error, in particular an erroneous or incomplete delivery address, LDB cannot be held responsible for the consequences in terms of delay or impossibility of delivery. All costs related to the reshipment of products due to a customer input error will be the sole responsibility of the customer.
Delivery times may not exceed 30 working days after the date of validation of payment by the Customer.
The times announced are ex-warehouse times.

Delivery tracking

After validation of the payment, an order number is assigned to you. Your order is then registered. We advise you to print the order number and keep it. You can follow the steps of its processing at any time within your Customer area "My Account".
The Customer must provide a valid e-mail address, failing which LDB cannot be held responsible for the consequences arising therefrom. The Customer must ensure that his data is updated in his Customer space.


Any order on the site and delivered outside France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination.
These customs duties and any taxes related to the delivery of an item are the responsibility of the customer and are his responsibility. LDB is not required to verify and inform its customers of applicable customs duties and taxes.


LDB cannot be held responsible for the non-performance of the contract concluded in the event of fortuitous event and force majeure as defined by law and case law.
The choice and purchase of a product are placed under the sole responsibility of the customer.


You have a period of 14 days from receipt of your order to make your return. Please note that the house does not make any exchange for an online purchase.

Return costs are your responsibility, so you can choose the carrier of your choice. We advise you to choose a tracked shipping method and keep the tracking number.

Once your return request has been received, you will receive a validation email with shipping instructions.

We will contact you upon receipt of your return.

The refund will take place after receipt of the return on the means of payment used during the order, within a maximum of 30 days.

Right to retract

Conditions of exercise and terms of return

In accordance with the provisions of article L.121-21 of the Consumer Code, the customer has a period of 14 days to exercise his right of withdrawal without having to justify any reason. The starting point of the period is the day of receipt of the order by the customer or by the third party designated by him.
If the 14-day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day.
In this context, he has the option of returning the items delivered within this period, in their original packaging, in perfect condition, complete (accessories, instructions, guarantee, etc.) and accompanied by a copy of the documents attached to his order, to the address indicated on the delivery slip.
It will be up to the customer to provide proof of this return, which assumes that the items must be returned by registered mail, or by any other means giving a certain date, the risks of the return remaining the responsibility of the customer.
For the purpose of good reception and in order to speed up the processing of the return, the customer must comply with the following procedure.


In the event of implementation of the right of withdrawal, LDB will reimburse the Customer for the price of the item(s) concerned.
In the event of the return of one or more items that are the subject of a promotional offer or sales, the amount of the refund will be that shown on the invoice attached to the package.
Reimbursement will take place after receipt by LDB of the item(s) subject to the Customer's withdrawal.
The refund will be made according to the means of payment of the returned order, within 30 days from the exercise of the right of withdrawal.
Reimbursement cannot be made if the article concerned has suffered a depreciation resulting from manipulations other than those necessary to establish its nature, its characteristics and/or its conformity.

Legal guarantees

Guarantee of conformity and guarantee against hidden defects

The products benefit from the legal guarantee of conformity (article L 211-4 and following of the Consumer Code) and the guarantee against hidden defects (article 1641 and following of the Civil Code). Any warranty is excluded in the event of damage of external origin or resulting from misuse, improper use, negligence or lack of maintenance on the part of the Customer, as in the case of normal wear and tear of the product.
Article L211-4 of the Consumer Code
The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery (…).
Article L211-5 of the Consumer Code
To be in conformity with the contract, the good must:
1º Be fit for the use usually expected of a similar good and, where applicable: correspond to the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model ; present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;
2º Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and which the latter has accepted.
Article L211.7 Consumer Code
The defects of conformity which appear within six months from the delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise.
The seller can challenge this presumption if it is not compatible with the nature of the goods or the lack of conformity invoked.
Article L211-9 Consumer Code
In the event of a lack of conformity, the buyer chooses between the repair and the replacement of the good. However, the seller may not proceed according to the choice of the buyer if this choice entails a manifestly disproportionate cost with regard to the other method, taking into account the value of the good or the importance of the defect. He is then required to proceed, unless this is impossible, according to the method not chosen by the buyer.
Article L211.10 Consumer Code
If the repair and replacement of the good is impossible, the buyer can return the good and have the price refunded or keep the good and have part of the price refunded.
The same option is offered to him:
1° If the solution requested, proposed or agreed pursuant to Article L.211-9 cannot be implemented within one month of the buyer's complaint;
2° Or if this solution cannot be without major inconvenience for him given the nature of the property and the use he is looking for.
However, the resolution of the sale cannot be pronounced if the lack of conformity is minor.
Article L211-12 Consumer Code
The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
Article L211-13 Consumer Code
The provisions of this section do not deprive the buyer of the right to exercise the action resulting from redhibitory defects as it results from articles 1641 to 1649 of the civil code or any other action of a contractual or extra-contractual nature which is recognized to him. by the law.
Article 1641 of the Civil Code
The seller is bound by the guarantee on account of hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid less if he had known them.
Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.
The guarantor of the defects of the thing sold is SA MOD DESIGN whose head office is located at 103 rue Lafayette, 75010 PARIS. When acting as a legal guarantee of conformity, the customer, has a period of two years from the delivery of the goods to act, can choose between the repair or the replacement of the goods, subject to the cost conditions provided for by Article L. 211-9 of the Consumer Code, is exempted from providing proof of the existence of the lack of conformity of the goods during the 6 months following the delivery of the goods. The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.
The customer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the Civil Code and can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

Intellectual property

All elements of the LDB site, whether visual or audio, are protected by copyright, trademarks or patents. They are the exclusive property of MOD DESIGN - LDB. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private use is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code.
Any total or partial reproduction of the LDB site is strictly prohibited without prior agreement.


The company MOD DESIGN - LDB has, for all stages of access to the site, (the process of ordering, delivery, Customer Service or subsequent services), only an obligation of means. LDB cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.
In addition, the company MOD DESIGN - LDB cannot be held responsible in the event that the order does not succeed or if it is prevented from respecting any of its obligations for a case of force majeure within the meaning of case law, and in particular in the event of bad weather preventing the delivery of the order.


In the event that one of the clauses of this contract would be null and void by a change in legislation, regulation or by a court decision, this can in no way affect the validity and respect of these general conditions of sale.

The computerized registers, kept in the computer systems of the company MOD DESIGN - LDB and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.

Retention and archiving of transactions

The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the civil code.


These conditions are subject to French law.
In the event of a dispute, LDB and the customer will attempt to resolve it amicably. In case of failure of the transaction, only the French courts will be competent.

Mediation, applicable law and competent jurisdiction

The sale of Products is subject to French law.
In the event of a complaint not resolved amicably by Customer Service, and in accordance with Article L612-1 of the Consumer Code, the Customer may have free recourse to the mediation service of the Center for Consumer Mediation of Conciliators of Justice (CM2C ), to which LDB is a member, electronically at or by post: CM2C – 14 rue Saint Jean – 75017 Paris.
